CONDITIONS OF ENTRY “WIN A GIFT CARD FOR YOU & A FRIEND’ COMPETITION

The Promoter

1. The promoter is Flight Centre Travel Group Limited trading as Flight Centre (“Promoter”) of Southpoint, 275 Grey Street, South Brisbane QLD 4101, Australia

Conditions of Entry

2. Eligibility information and the prize offered form part of these Conditions of Entry. An individual that renders themself an Eligible Entrant is deemed to have accepted these Conditions of Entry.

3. Entry is open to residents of Australia who comply with the requirements set out in the “Eligibility for Promotion” terms stated in these Conditions of Entry ("Eligible Entrants").

4. Employees of Flight Centre Travel Group Limited, its related bodies corporate, and their immediate families are not permitted to enter.

Duration of Promotional Period

5. The promotion will commence at 9:00am AEST on Wednesday 04 December 2024 and will continue until 11:59pm AEST on Wednesday 18 December 2024 (“Promotion Period”).

Eligibility for Promotion

6. Eligible Entrants must: 
 
(1) Follow @flightcentreau on Instagram; and

(2) Like the Promoter’s competition post on Instagram or Facebook;

(3) Comment on the Promoter’s post and tag someone who needs a holiday and tell us why in 25 words or less

7. Entries will be deemed to be accepted at the time of the Prize Winner selection.

8. Entries received will be considered final by the Promoters. Entries which are incomplete, inaccurate, erroneous, illegible, inappropriate, offensive or incomprehensible or which infringe intellectual property rights will be deemed invalid.

9. Entries must be received by the Promoters during the Promotion Period. The Promoter does not accept responsibility for late, lost or misdirected entries.

10. Any costs associated with accessing the promotion are the responsibility of each entrant and are dependent on the Internet Service Provider used.

11. The Promoter takes no responsibility for any variation in the value of the Prize.

12. If the Promoter is unable to provide the Prize Winner with the nominated Prize, the Promoter reserves the right to supply an alternative Prize of similar monetary value, subject to any direction of a lottery authority.

13. If the Prize Winner does not accept any element of the Prize, the Promoter is not obliged to provide the Prize Winner with a substitute Prize. 

Selection of “Prize Winner” 

14. There will be 5 prize winners (“Prize Winners”). Each Prize Winner will receive 2 x $500 Flight Centre Gift Cards; 1 x $500 gift card for themselves and 1 x $500 gift card for the person that they tag in the competition post.

15. The Prize Winners will be selected on Thursday 19 December 2024 by a judging panel consisting of 3 judges and will take place at Southpoint, 275 Grey Street, Southbank, QLD 4101. 

16. All entries will be judged on the Entrant’s skill, which includes the Entrant’s ability to best reason why the person that they tag on the competition post needs a holiday (in the opinion of the judges, in their absolute discretion).

17. The promotion is a game of skill and chance will not play any role in determining the shortlisted finalists or the winners of the prizes. The Judging Panel’s decision is also final.  

18. The Prize Winners will be notified in writing and via Instagram from @flightcentreau’s account (using the contact details for the Prize Winner in the Promoter’s records) within three business days and no later than 5:00pm on Monday 23 December 2024 and will be requested to email marketing@flightcentre.com

19. The Prize Winners (including last name, first initial and postcode) will also be published on the Promotor’s Instagram account @flightcentreau and the Flight Centre Facebook account within 30 days of the prize draw.

20. The Promoter will not enter into correspondence regarding the result of the Prize Draw. 

21. If a Prize Winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the Prize Winner’s behalf. 

22. The Prize Winner will have until 5:00pm AEST on Sunday 23 March 2025 to claim the Prize. 

23. If any Prize has not been claimed by the Prize Winner by the date specified in Clause 24, The promoter will award the Unclaimed Prize to a runner up entrant who will be notified on Wednesday 8 January 2025 ("Unclaimed Prize Draw"). 

24. The winner of the Unclaimed Prize Draw will be notified via phone and in writing (using the contact details for the winner of the Unclaimed Prize Draw in the Promoter’s records) within seven days of the Unclaimed Prize Draw. 

25. The winner of the Unclaimed Prize Draw (including last name, first initial and postcode) will also be published on the Promotor’s website at 
https://www.flightcentre.com.au/p/competition/dream-holiday within 30 days of the Unclaimed Prize Draw.  

26. The Promoter can accept no responsibility for entries delayed, misdirected or undelivered. Incomplete entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition.  

27. The Promoter reserves the right to terminate the competition and withhold the Prize in the event that, in the Promoter's opinion, there are insufficient entries for the Promoter to be able to select a Prize Winner or where, in the Promoter’s opinion, improper conduct by an entrant (or any number of them) has rendered the competition unfair to all entrants. The Promoter’s decision is final with respect to any aspect of the competition, including the determination of any Prize Winner. No correspondence will be entered into. 

Prize Details

28. Each Prize Winner will win 1 x Flight Centre gift card to the value of $500 AUD (The ‘Prize’).

30. Eligible Entrants may only receive one (1) prize across the Promotion Period.

31.    The Prize Winner(s) (by accepting a Prize) agrees that they will abide by the applicable terms and conditions for the use of the Prize as notified by the Promoter. 

32. The Prize Winners will be responsible for any tax liability (where applicable) that may arise from being awarded the Prize.

33. The Prize Winners must take the prize as offered. The prize is non-transferable, non-refundable, cannot be sold or exchanged for cash (except as permitted through normal use of the prize) and cannot be used in conjunction with any other offer.

34. For the avoidance of doubt, the Prize does consist of anything other than expressly set out in the conditions above. All fees and expenses related to delivery, acceptance, and use of the Prize are solely the responsibility of the Winner and/or their guest(s), as applicable.   

35. The Prize is subject to the additional terms and conditions (including without limitation gift card terms and conditions https://help.flightcentre.com.au/s/article/gift-card-terms-of-use-au, currency card terms and conditions, conditions of carriage, activity waivers, and conditions and additional charges (as applicable) in relation to optional and included activities) of the Promoter and its suppliers and the Prize Winner and their guest(s) shall enter into all necessary contracts and paperwork directly with the Promoter as by the Promoter shall require. The Prize Winner’s recourse shall be against the Promoter only, with respect to the terms and conditions and legal documentation stipulated in these conditions. 

36. If due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated Prize to a Prize Winner (for reasons other than the Prize Winner and their guest(s) being unable and/or unavailable to use the Prize), the Promoter reserves the right to award a substitute prize of equal value or greater value. 

General

37. The personal information of entrants will be collected to enable the Promoter to administer and promote this promotion and to contact the Prize Winner (or, if applicable, the winner of an Unclaimed Prize Draw).  Entrants agree that the Promoter may handle their personal information in accordance with the Promoter's privacy policy, which is available at:           https://help.flightcentre.com.au/s/article/privacy-policy-au (Entrants agree that the Promoter may use their personal information for marketing purposes.  If an entrant does not truthfully provide all requested personal information, the Promoter may determine that they are not eligible to win the Prize. 

38. Any personal information held by the Promoter and/or the Promoter in respect of any competition will be held on record for a reasonable period to fulfil the purpose for which such personal information was collected. If an entrant gives the Promoter permission to pass on their personal information to a third party then this shall no longer be the responsibility of the Promoter and shall be subject to the privacy policy of that third party. 

39. The Prize Winner consents to the use of their name, and social media name or handle for promotional and marketing purposes. The personal information of the Prize Winner and their travel companion(s) (if applicable) may be provided to others assisting, including Prize suppliers and deliverers, and to authorities that regulate this promotion.  

40. All entrants who submit any entry to the Promoter: (a) grant the Promoter and its licensees and assignees a non-exclusive license to exercise all rights in perpetuity throughout the world in the entry material and all other material provided by the entrant to the Promoter pursuant to this promotion at any time; and (b) represent and warrant that the exercise of the rights granted to the Promoter in these terms and conditions will not infringe the rights of any        third parties; and (c) indemnify the Promoter against any loss or damage resulting from any            breach of the foregoing representation and warranty. 

41. Any personal information held by the Promoter and/or the Promoter in respect of any competition will be held on record for a reasonable period to fulfil the purpose for which such personal information was collected. If an entrant gives the Promoter permission to pass on their personal information to a third party then this shall no longer be the responsibility of the Promoter and shall be subject to the privacy policy of that third party. 

42. To the extent permitted by law, the Promoter is not responsible or liable for:

1. inaccurate/incorrect transcription of entry information;
2. purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;
3. any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
4. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
5. unauthorised human intervention in any part of the competition;
6. electronic or human error which may occur in the administration of the competition;
7. any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss arising in connection with the arrangement for supply, or the supply, of any goods or services by any person to a Prize Winner and, where applicable, to any family/persons accompanying a Prize Winner; or
8. any injury or damage to persons or property, including to the entrant’s or any other person's computer related to, or resulting from, participation or downloading any materials in this competition. 

43. The Promoter will not be liable for personal injury suffered during participation in the promotion or use of the Prize, except to the extent directly caused by the Promoter's negligence. If requested by The Promoter, the Prize Winner(s), and his or her guests, must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a Prize being awarded. Failure to return the signed releases   and indemnities may result in the entitlement to the Prize being forfeited and the selection of         another Prize Winner. 

44. These above conditions do not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again. 

45. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
