5. If due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated Prize to a Prize Winner (for reasons other than the Prize Winner and their guest(s) being unable and/or unavailable to use the Prize), the Promoter reserves the right to award a substitute prize of equal value or greater value.
8. Flight Centre will not be liable for any loss or damage sustained to person or property, including but not limited to personal injury suffered during the use of the Prize or consequential loss (including economic loss) arising or in connection with the Prize, except to the extent directly caused by Flight Centre's negligence. If requested by Flight Centre, the Prize Winner(s), and his or her guests, must sign and return any liability release and indemnity provided by Flight Centre and/or its contractors as a condition of a Prize being awarded. Failure to return the signed releases and indemnities may result in the entitlement to the Prize being forfeited and the selection of another Prize Winner.
